A civil action was brought by the plaintiff who was injured on September 14, 1940, while he was working aboard the defendants vessel, the S. S. Steel Pier, docked at Commercial Wharf, Boston, for the recovery of damages under Section 33 of the Merchant Marine Act of 1920, 41 Stat. 1007, 46 U.S.C.A. Â§ 688, called the Jones Act. After the presentation of the plaintiffs evidence, the defendant moved for a directed verdict on the grounds that there was insufficient evidence of negligence, that the plaintiff was not a seaman under the Jones Act and, even if he were, his sole remedy was under the Longshoremens and Harbor Workers Compensation Act, hereinafter called the Longshoremens Act, 44 Stat. 1424, 33 U.S.C.A. Â§ 901 et seq., because he was not a "member of a crew".
